The same problems that have plagued the foreclosure process are now routinely being found in the debt collection practices of credit card companies.
According to judges who oversee these cases, many of the lawsuits rely on erroneous documents, incomplete records and generic testimony from witnesses. The judgments are awarded simply because most consumers ignore the lawsuits. Why? For a variety of reasons. Some because they think they can’t afford it; some because they don’t know they have a defense; some because they didn’t get service. Many of these judges feel their hands are tied, but would welcome consumers forcing debt collectors to prove their case.
